Terms and Policy

Booking a session and/or submitting any form of payment constitutes full acceptance of all terms, policies, pricing, and conditions set forth by Kimberly Jackson Photography. Payment confirms the client’s agreement to be bound by these terms

without exception. 

1. Permission to be Photographed 

The client/talent hereby grants permission and fully consents to being photographed by Kimberly Jackson Photography and Kimberly Jackson. 

 

2. Copyright & Usage Rights

Photographer retains 100% copyright ownership of all photographs and videos. Kimberly Jackson Photography is granted an irrevocable, worldwide, perpetual license to use all images and video captured during the session in any medium or format for portfolio, editorial, commercial, advertising, marketing, publicity, publication, exhibition, promotion, and personal or professional projects. This includes the right to reproduce, publish, display, license, or sell images and video to third parties for profit.

 

3. Client Usage License

Client/talent is granted a non-exclusive, non-transferable license for personal use only, including social media posting, personal branding, comp cards, and personal portfolio use. This license does not transfer copyright ownership.

 

4. Commercial Use Restriction

Any commercial or revenue-generating use—including but not limited to advertising, paid promotions, sponsorships, brand partnerships, product endorsements, marketing materials, media/press usage, or third-party licensing—requires prior written consent from the photographer and the purchase of a separate commercial license with applicable fees. This applies to all current and future uses, regardless of when compensation, profit, or value is received.

 

5. Creative Direction & Image Control

Photographer retains full control over:

 

Editing style

Final image selection

Creative direction

 

However: Client/talent is responsibility for informing the photographer of any specific photographs they desire. The client shall provide the photographer with a written list of photographs and poses desired. The photographer is not responsible for any photographs not captured or non-produced photos if the client fails to provide a written list of photographs and poses desired. Failure to plan on client/talent part does not constitute an emergency on mine photographer. If any project is rushed, charges will incur up-front non-refundable and non-negotiable.

 

Unedited/raw images will not be provided.

 

6. Location

Client/talent may select their preferred location(s) for the session. Additional fees may apply for multiple locations, travel, parking, admission costs, permits, or venue-related expenses—please consult with the photographer in advance. Requests for multiple locations may also require additional session time and may be subject to scheduling limitations and added fees. The photographer reserves the right to decline location changes or additional locations that may negatively impact timing, session flow, safety, or the quality of 

services provided.

 

If the client/talent chooses to leave location selection to the photographer, the photographer will select a location based on creative direction, availability, accessibility, lighting conditions, and the overall needs of the session. Final location decisions made by the photographer are considered accepted by the client unless otherwise discussed prior to the session. The photographer cannot guarantee specific environmental conditions, weather, crowds, venue availability, or circumstances beyond their control at any selected location.

 

Sessions may be rescheduled due to inclement weather, illness, unsafe conditions, location restrictions, or other safety concerns that may negatively impact the session experience or well-being of those involved. The photographer reserves the right to determine whether conditions warrant rescheduling in order to ensure the safety, quality, and success of the session.

 

7. Liability

The photographer reserves the right to cease, suspend, discontinue, or terminate the session at any time if the client, photographer, or any member of the photographer’s team encounters an unsafe, hazardous, inappropriate, or otherwise uncomfortable environment or situation. In such cases, the photographer shall not be held liable for any losses, costs, damages, claims, or expenses resulting from the suspension, discontinuation, or termination of the session.

 

The client acknowledges that participation in the use of props, posing, modeling activities, and related session elements is voluntary and undertaken at their own risk. The photographer shall not be held responsible for any discomfort, injury, or issues arising from participation in such activities. If concerns arise, the photographer may pause the session to reassess the situation and make reasonable adjustments when possible. Likewise, if the photographer or any member of the photographer’s team experiences discomfort or safety concerns, the photographer reserves the right to immediately suspend or discontinue the session.

 

8. Payments, Rescheduling, and Cancellation Policy

All payments, including deposits, are non-refundable and non-transferable. Payments are considered final sales, which include deposits, full payments, canceled sessions, and rescheduled sessions. Client/talent must provide at least 3 days’ notice to cancel or request rescheduling session date for local sessions. For sessions taking place more than two hours from Baton Rouge, Louisiana, clients must provide a minimum of four (4) weeks’ notice to cancel or request rescheduling. Failure to provide proper notice will result in the client/talent being responsible for the full photography service amount. Sessions may be rescheduled due to weather, illness, or safety concerns. In such cases, both client/talent and photographer must agree in writing to the new arrangement. Only one rescheduling and relocation is permitted under the same booking/session date. A second request may require a new booking. If the photographer has arrived and begun photographing on the scheduled date, the full payment is required. Clients are required to comply to policy. 

 

9. Prices

Session prices may vary based on package, duration, and services requested. Both the client and the photographer must agree to and confirm all pricing and budgets prior to the session.

 

10. Travel, Access & Expenses

Client/Talent agrees to: Provide necessary access (backstage, venue, etc.) Ensure Photographer is properly credentialed if required. Client/talent is solely responsible for all costs and expenses associated with the project, including but not limited to: Photographer’s fees, assistant fees, travel arrangements (flights, mileage, etc.), transportation, accommodations, meals, props, and any additional expenses incurred in connection with the services provided. Client/talent is also responsible for all of their own expenses, including but not limited to travel, transportation, accommodations, styling (arranging their own hairstyle, makeup, attire), and personal costs. All expenses must be covered and/or reimbursed in full by client/talent unless otherwise agreed in writing prior to the shoot.

 

11. Late Policy

Client/talent are granted a 10-minute grace period from the scheduled start time. After the grace period, a late fee of $25 will be charged for every 10 minutes of delay. The client will be notified of all late fees and must agree to payment in order for Kimberly Jackson Photography to continue services. If the client fails to arrive after the grace period, the photographer reserves the right to cancel the session, end services, and leave the location. All payments made are final, non-refundable, and non-transferable to other services.

 

12. Preparedness Policy

Clients are expected to arrive fully prepared to begin the session at the scheduled start time, including being dressed, camera-ready, and prepared with all necessary wardrobe, props, participants, and session details. Time spent preparing after the scheduled start time, including changing outfits, hair and makeup touch-ups, gathering participants, or organizing session items, may reduce the allotted session time and may result in additional fees at the photographer’s discretion. If the client is not prepared to begin within a reasonable timeframe (20 minutes or less), the photographer reserves the right to suspend, shorten, or discontinue the session.

 

13. Additional Participants Policy

Any request to add participants after booking or at the time of the session must be approved by the photographer in advance. Additional participants may result in added fees, extended session time charges, and modifications to the original session plan. Failure to disclose additional participants in advance may affect the session experience and available shooting time.

 

14. Client/Talent Independent Relationship

Both photographer and client/talent acknowledge that they are independent entities. This Agreement does not create any partnership, joint venture, or exclusive relationship beyond the terms outlined herein.

 

15. Non-Exclusivity & Right to Decline Future Work

This agreement applies solely to the services outlined above and does not establish an ongoing or exclusive working relationship.

 

The photographer reserves the right to:

 

• Decline future projects

• Discontinue collaboration at their discretion

• Accept work from other clients, including within the 

same industry

 

16. Turnaround Time

Final edited images are typically delivered within 3 weeks. Turnaround time may vary depending on the scope, size, and complexity of the session. Larger sessions, events, or sessions requiring extensive editing may require additional processing time. Rush delivery may be available upon request and approval, subject to additional fees.

 

17. Entire Agreement

This agreement represents the entire understanding between the parties and supersedes all prior negotiations or agreements.

Any changes must be in writing and signed by both parties. By booking a session and/or submitting payment, the client acknowledges and agrees to all Kimberly Jackson Photography terms, policies, and conditions. 

Client/talent must be over the age of 18 years to book a photo session or model a photo session. If you are not 18 years old, you must have a parent or guardian over the age of 18 to book your photo session. Participants under 18 years must have a signed parental/guardian consent form before the session. Identification check enforced. Parents, please monitor your children and loved ones during photo sessions, or have someone from your party monitor them during a photo session. All models and their parties are liable for themselves and agree to participate in any photo session at their own risk. The photographer will not be responsible for your children or loved ones during a photo session. Kimberly Jackson Photography, Kimberly Jackson will NOT be held responsible for any consequences regarding illness, injuries, and fatal situations (death or life-changing situations) during or after photography service, or during meetings regarding photography service.
